BIDENOMICS: Hooters Abruptly Closes 40 Locations, Citing Rampant Inflation

The iconic restaurant chain Hooters has abruptly announced the closure of 40 locations nationwide, citing the rising cost of food and rent.

The restaurant chain, known for its attractive and scantily dressed waitresses, will close stores in Florida, Kentucky, Rhode Island, Texas, and Virginia.

“Like many restaurants under pressure from current market conditions, Hooters has made the difficult decision to close a select number of underperforming stores,” a Hooters spokesperson told the Daily Mail.

“We look forward to continuing to serve our guests at home, on the go and at our restaurants here in the US and around the globe,” they added.

While Hooters may not be to everyone’s taste, the closures are further evidence of the economic toll caused by rampant inflation, which has soared since the Biden regime seized office in 2021.

Last month, the Red Lobster restaurant chain announced that it would be filing for bankruptcy and closing nearly 120 restaurants across 27 states after sustaining continued losses.

Meanwhile, a recent survey by Lending Tree found that having once been an affordable alternative for lower-income workers, nearly 80 percent of Americans now consider fast food to be a “luxury item.”

“Americans love fast food, but costs are forcing them to curb their cravings,” the survey stated. “3 in 4 Americans typically eat fast food at least once a week, but the majority (62%) say they’re eating it less due to rising prices. In fact, 65% of Americans have been shocked by the high price of a fast-food bill in the past six months.

“78% of consumers view fast food as a luxury because it’s become increasingly expensive. Additionally, half of Americans say they view fast food as a luxury because they’re struggling financially,” it continued. “This is especially true among Americans who make less than $30,000 a year (71%), parents with young children (58%), Gen Zers (58%) and women (53%).”

America First Legal Sends Directive to All 50 States on Preventing Illegal Aliens from Voting Amidst Reports of Biden Regime Distributing Social Security Numbers and Voter Registration to Illegals

America First Legal President Stephen Miller (Credit: Getty Images)

America First Legal (AFL), a conservative legal group, has sent letters to officials in every state urging them to enforce existing laws that prevent illegal immigrants and non-US citizens from registering to vote or casting ballots in elections.

The AFL letter was addressed to the chief election official of all 50 states, with copies sent to each Governor and Attorney General. The letter outlined how two key existing federal laws could be used to obtain information from the U.S. Department of Homeland Security about the citizenship or immigration status of any individual for “any purpose authorized by law.”

“Biden is giving registration forms and social security numbers to illegals. America First Legal is sending an urgent ACTION PLAN to officials in all 50 states on how to stop illegals & non-citizens from voting. States must ensure only citizens vote,” AFL wrote on its social media.

Stephen Miller, former senior advisor to President Trump and America First Legal President, said, “Joe Biden is mass importing criminal migrants, giving them social security numbers, and handing out voter registration forms to migrants, and vigorously opposes any and every effort to verify the citizenship of voters before voting. This is a clear, unambiguous, and direct effort to sabotage the 2024 election through potential mass illegal alien voting — aiding and abetting dramatic foreign interference and the subversion of our democracy.”

Gene Hamilton, America First Legal Executive Director, added, “States have the utmost authority, obligation, and expectation from the American people to prevent noncitizens from voting in elections. Congress has equipped States with the tools necessary to verify the citizenship status of registered voters and remove ineligible foreign nationals – but States must act swiftly to ensure that only citizens vote in this fall’s elections.”

According to the news release:

The Problem: The issue of noncitizens voting in federal elections can be complex–including what States are and are not allowed to do when voter applicants use the federal form:

Federal law prohibits foreign nationals from voting or registering to vote in federal elections.
Federal law also imposes upon States an obligation to conduct voter list maintenance.
The U.S. Election Assistance Commission (EAC) created a federal voter registration form that does not require applicants to demonstrate proof of citizenship. Instead, it merely requires voter registrants to sign a form “under penalty of perjury,” swearing or affirming that “I am a United States citizen.”

The Supreme Court of the United States previously held that because the National Voter Registration Act (NVRA) requires that States must “accept and use” the EAC form–which does not require documentary proof of citizenship–then “the NVRA forbids States to demand that an applicant submit additional information beyond that required by the Federal Form.”
The result is that, under current law as interpreted by the Supreme Court, anyone can register to vote using the EAC Federal Form without providing documentary proof of citizenship.

This outrageous state of affairs, which is completely contrary to common sense and the practices of other countries across the world, has led to numerous bills being introduced to correct the situation at the point of voter registration—such as the SAVE Act. Such bills are essential to protect the integrity of our elections. This plan provides something that States can do NOW until legislation like the SAVE Act becomes law.

Further, aside from the weaknesses in the EAC Federal Form, there are gaps and loopholes in the voter registration process in States that do not (or did not in the past, particularly prior to the requirements of the REAL ID Act of 2005 related to driver’s licenses) require documented proof of citizenship.
Even DHS’s Systematic Alien Verification for Entitlements (SAVE) program, which many states use in various ways to determine eligibility for access to benefits for aliens in the United States, has critical flaws that make it unworkable for most States and localities to use to verify a voter registrant’s citizenship status.

Most notably, SAVE requires users to submit an Alien Registration Number or some other DHS identifier to run queries through the system–something that States and localities do not have when registering someone to vote.

Accordingly, under the status quo, States and localities have generally been unable to ensure that aliens are not registered to vote and that they ultimately do not vote in federal elections.

The Solution:

Two federal statutes that have been on the books for nearly three decades allow states to obtain information about the citizenship or immigration status of any individual for any lawful purpose. Specifically, 8 U.S.C. § 1373(c) provides that (the reference to the former Immigration and Naturalization Service, abolished twenty-three years ago, now means the Department of Homeland Security):

Further, 8 U.S.C. § 1644 provides that:

Each statute makes clear that States and localities can submit a request to DHS to obtain the citizenship or immigration status of any individual “for any purpose authorized by law.” And further, not only can they request the information, but DHS “shall respond” to such a request, and they cannot be prohibited or restricted from receiving that information.

As explained above, federal law unambiguously requires that voters in federal elections be United States citizens and prohibits all foreign nationals, even those who are lawfully present in the United States, from registering to vote or voting. Federal law also imposes on States the duty of ensuring that ineligible voters are removed from voter rolls. Also, many States impose citizenship requirements under State law, and 8 U.S.C. § 1644 confers on States unrestricted authority to obtain information about the immigration status of aliens in the United States. Therefore, it is a “purpose authorized by law” under 8 U.S.C. § 1373(c) for a State to ask DHS about the citizenship status of presently registered voters.

Accordingly, States and localities should submit requests to DHS to verify the citizenship or immigration status of registered voters on voter rolls where there are any reliable indicators that a voter may not be a U.S. citizen.

While foreign nationals voting in American elections is a serious problem under any circumstances, under President Biden’s abysmal leadership, America is facing the greatest immigration crisis the world has ever witnessed. With legions of illegal aliens crossing the border every day and programs that fly hundreds of thousands of illegal aliens into cities across the United States, the likelihood and volume of noncitizen voting has never been higher.

You Can’t Make This Up: Experts are Now Investigating Whether Milk is Racist in Government-Funded Study on Dairy’s Ties to Colonialism

“The milk traces in ancient pots confirms the story that bones have been telling us about how pastoralists lived in eastern Africa 5,000 to 3,000 years ago—an area still famous for cattle herding and the historic way of life of people such as Maasai and Turkana,” says Fiona Marshall. (Credit: mar is sea Y/Flickr)

The Maasai in Kenya, a notorious “White Supremacy” known for their traditional cattle-raising practices, have been consuming milk for centuries as a staple part of their diet.

The Maasai value cattle, and the size of their herds indicates their status in the community. Maasai women are responsible for milking the cows, and the milk is a key part of their diet, appearing in almost every meal.

The Maasai drink milk raw or soured, in tea, or turned into butter, which is especially important for infants. They also produce a traditional fermented milk product called kule naoto from unpasteurized whole milk from zebu cows, which they consume in large quantities, averaging 2–3 liters per person per day.

In the latest display of far-left absurdity, taxpayer money is now being funneled into a study investigating the supposed ties between milk and colonialism.

Yes, you read that correctly.

Back in 2018, the New York Times published an article titled, “Why White Supremacists Are Chugging Milk (and Why Geneticists Are Alarmed).” In 2017, leftist PETA also published an article titled, “Why Cow’s Milk Is the Perfect Drink for Supremacists.”

Now, it seems academics at Oxford are jumping on the bandwagon, ready to dissect the ‘political nature’ of milk and its so-called ‘colonial legacies.’

This new project, intriguingly titled ‘Milking it: colonialism, heritage & everyday engagement with dairy’, has won funding from the Arts and Humanities Research Council, according to the Daily Mail.

The council itself is funded by the Government through the Department for Business, Energy and Industrial Strategy, and awards around £110 million ($140 million) to researchers at universities and independent organisations, the news outlet added.

The exact size of the grant has not yet been revealed. The museum stated that the project aims to centre on heritage as a vital framework for understanding how colonial legacies influence contemporary issues and affect people’s lives.

Through a variety of methods including milk diaries, archival research, and participatory podcasting, it will investigate historical engagement with milk, building networks with consumers and producers in Britain and Kenya.

Daily Mail reported:

Dr Zetterstrom-Sharp, a University College London associate professor at the Institute of Archaeology, and Dr JC Niala, head of research at the History of Science Museum.

Dr Zetterstrom-Sharp took part in a talk titled Milk and Whiteness during a Wellcome Trust exhibition on milk in 2022.

In the panel discussion, she said a ‘Northern European obsession with milk’ had led to the assumption that it was a vital part of any human diet, and should be produced and provided on a vast scale.

The Wellcome Trust exhibition highlighted the imposition of dairy economies by colonial powers, including in regions where populations had high levels of lactose intolerance.

Dr Zetterstrom-Sharp also highlighted issues with the way local milk production in Africa may have been quashed in favour of industrial methods aimed at producing greater volume, and how milk has been distributed by aid organisations.

Nonpartisan Election Validity Group Files Landmark Lawsuit in Pennsylvania

Guest post by Joe Hoft at JoeHoft.com – republished with permission

Nonpartisan Election Validity Group Files Landmark Lawsuit in Pennsylvania

Guest post by Jack Gleason

United Sovereign Americans, Inc., a nonpartisan, all-volunteer election validity advocate group, and two Pennsylvania residents, have filed a Writ of Mandamus, directed to the following Pennsylvania officials and organizations – Secretary of the Commonwealth, the Bureau of Elections, the Bureau of Election Security and Technology, the Department of State, and the state Attorney General.

They have also named Attorney General Merrick Garland and the United States Department of Justice as additional “Respondents.”

They are claiming that the officials named above are not performing their duty to follow existing laws that safeguard our elections.

“A writ of mandamus is a judicial remedy in the English and American common law system consisting of a court order that commands a government official or entity to perform an act it is legally required to perform as part of its official duties, or to refrain from performing an act the law forbids it from doing. Writs of mandamus are usually used in situations where a government official has failed to act as legally required or has taken a legally prohibited action.”

The Petitioners assert, “The Congress of the United States has outlined the minimum standards which must be maintained by every state in order for a federal election to be considered reliable. As outlined below, in Pennsylvania’s 2022 federal election those minimum standards were not met by commonwealth election officials rendering the certified election results that year unreliable. Respondents in their official capacities engaged in insufficient efforts to ensure that the 2022 performance is not repeated in subsequent federal elections beginning in 2024.”

These standards include…

only properly registered voters cast votes

only votes properly cast are counted correctly

all voting systems are compliant with all critical infrastructure requirements and every ballot is correctly and uniformly processed, as well as accurately tabulated and secured

the authenticity of every ballot counted is proven by the maintenance of a comprehensive, unbroken chain of custody from the voter’s hand to the final certified result, and the Commonwealth election officials maintain records of said chain of custody post-election

and certification of future elections is understood to be an official act under penalty of perjury.

“The certification by Pennsylvania officials of the 2022 election was done despite the integrity of the election being suspect on account of apparent error rates occurring in that election that exceeded the error rate Congress permits before federal election results cannot be relied upon as accurate, and the Commonwealth did nothing to investigate those apparent errors before certifying the election.”

They cite “the fact that Pennsylvania’s voter registration rolls, contained hundreds of thousands of potential errors at the time of the 2022 General Election… in the form of illegal duplicate registrations, voters with invalid or illogical voter history, voters placed in inactive statuses on questionable authority, backdated registrations, registrations with a modified date prior to registration, invalid or illogical registration dates, age discrepant registrants, and registrants with questionable addresses.”

They conclude, “Such errors jeopardize the validity of elections throughout the Commonwealth, bring doubt as to the accuracy and integrity of the Commonwealth’s currently-in-place voting systems, undermine Pennsylvanian’s collective voting rights, all in violation of existing state and federal election laws.”

These issues have been brought to the attention of the Respondents, “who have done absolutely nothing to address these errors ensuring future elections will suffer from the same deficiencies.”

Individual Petitioners include Diane Houser. In 2022, she discovered that her vote was not recorded in Pennsylvania’s Statewide Uniform Registry of Electors (“SURE”) system, even though she had voted in person. She reported numerous issues to authorities and was ignored numerous times.

Dean Dreibelbis observed and reported numerous election issues, apparent errors, loopholes, and discrepancies to authorities and was, each time, ignored.

Although not involved in this action, the Petitioners cite data from Audit The Vote PA, a non-partisan, non-profit organization organized in Pennsylvania. Although not a named petitioner, they also uncovered overwhelming evidence of registration problems in the 2020 and 2022 elections. For the 2022 election they found…

54,463 people voted in a county in which they were no longer living; and 8,177 people voted despite not actually living in Pennsylvania;

6,356 people were credited as submitting a mail-in ballot, but did not have any votes credited in Pennsylvania’s SURE system;

69,832 mail ballots were sent to an address unaffiliated with the voter’s registration;

18,589 people requested multiple ballots be sent to multiple addresses, with some people requesting additional ballots to be sent to up to four (4) separate addresses; and

5,492 registrations show as having two votes on record in two separate counties.

They cite Help America Votes Act (“HAVA”), the 14th Amendment of the United States Constitution, “Marbury v. Madison,” the National Voter Registration Act (“NVRA”), and existing Pennsylvania election laws.

The Petitioners are not accusing anyone of election fraud or aiming to overturn any election. Instead, they wish to counter future election irregularities and ensure the rights of Pennsylvania citizens.

United Sovereign Americans peer-reviewed data teams analyzed Pennsylvania’s voter registration data from the 2022 general election and found “hundreds of thousands of voter registration apparent errors in the Commonwealth of Pennsylvania. These apparent errors were not uniform across Pennsylvania – some counties had far more registration apparent errors than others.”

Out of 8,755,458 voter registrations, there was a total of 3,192,069 voter registration violations including:

20,097 illegal duplicates, where the same voter has multiple registrations

43,083 illegal or invalid vote history

28,256 backdated registrations

268,493 registrations where the period of active registration conflicts with the registration participation

448,335 invalid or illogical registration dates

633,508 illegal or invalid registration changes

154,913 registrants with questionable address

1,580,750 registrations with records altered after certification

They found 1,198,598 evident voting violations, and 1,089,750 unique votes impacted by apparent voting violations, including…

8,026 illegal duplicates, where the same voter has multiple registrations.

340,266 invalid or illogical registration dates

632,215 illegal or invalid registration changes

59,609 registrants with questionable addresses

138,291 registrants with altered votes after certification

Bruce Castor Jr., the lawyer who took up the case on behalf of United Sovereign Americans, has had a long career in Pennsylvania and has represented clients from Bill Cosby to Rudy Giuliani. He is a former Montgomery County district attorney and county commissioner who briefly served as acting Pennsylvania attorney general in 2016. Perhaps most notably, Castor defended Donald Trump in 2021 during the former president’s second impeachment trial in the U.S. Senate.

Castor said, “Congress set minimum standards for every federal election to be considered reliable… In Pennsylvania’s 2022 federal election those minimum standards were not met by Commonwealth election officials rendering the certified election results that year unreliable. Respondents have engaged in insufficient efforts to ensure that the unreliable 2022 performance is not repeated in subsequent federal elections beginning in 2024.”

The United Sovereign Americans mission is “to guard the validity of elections through education and litigation.” They have representatives in over twenty states analyzing voter databases and preparing legal actions. They recently joined a lawsuit in the state of Maryland, which is working its way through the courts.

EXCLUSIVE: What’s Happening in Lynchburg, Virginia? Shocking New Video Reveals Ballot Dropbox Left Open for Days, Mail-In Ballots Collected After Election, and No Security Camera Present!

Lynchburg, Virginia election official admits the ballot drop box was not emptied until days after the election.

As reported last week at The Gateway Pundit, the integrity of the Republican primary in Lynchburg has been called into question following a series of alleged procedural breaches.

The campaigns of Peter Alexander and Chris Faraldi, both candidates in the June 18th primary for City Council in Ward 4, reported multiple irregularities, including issues with mail-in ballots and potential breaches in the chain of custody.

According to the Lynchburg City Registrar, the race remains too close to call, with incumbent Chris Faraldi holding a narrow lead of 21 votes over Peter Alexander for the Ward 4 seat.

Source: City of Lynchburg, VA (.gov)

Concerns about the Lynchburg Republican primary center on several key issues. Primarily, there are significant concerns regarding the chain of custody of ballots collected from drop boxes.

Additionally, absentee ballot processing began before observers were permitted to monitor the process. Records also show that ballot box seals were broken before observers could watch, suggesting potential tampering or mishandling of ballots.

BREAKING: Poll watchers in Lynchburg, Virginia have released BOMBSHELL proof of fraud that took place in Tuesday’s election. They were prevented from seeing mail-in ballot processing and records show ballot box seals broken and ballots counted without anyone watching

Election… pic.twitter.com/AN2F9qD9Jj

— George (@BehizyTweets) June 23, 2024

Peter Alexander’s campaign released the following statement:

“Election staff informed us that drop box bags from the precincts were pulled by electoral board member Steve Troxel on Thursday morning after the primary.

Concerns have arisen about the chain-of-custody of these ballots, and there is no documentation recording the number of ballots collected from each Election Day drop box bag in Ward IV. Why weren’t these ballots counted on election night?

On Friday, our observer was turned away from absentee ballot processing when it was scheduled to start at noon and asked to return 30 minutes later. Records show that ballot box seals were broken and absentee ballot processing started before our observer was permitted access to watch the process.

My opponent did not have any official observers present until after we raised concerns about the chain of custody of drop box ballots. Election staff confirmed that it had been standard practice to allow the ballot drop box to be stuffed until Friday, which violates Virginia law.”

Read the full press release here about the extraordinary chain of custody failures reported by Peter Alexander’s campaign.

Incumbent Ward IV Representative and Vice Mayor of Lynchburg Council, Chris Faraldi, also released his own statement regarding the election fraud allegations.

Read below:

We were made aware that the Lynchburg Registrar’s Office improperly handled ballots in obvious and flagrant violation of state code and election procedures.

Their ballot drop box was left unlocked and open. They miraculously found ballots in that unlocked drop box 3 days after the election, noon Friday, and began processing them. That’s well past Election Day and in violation of state law.

Furthermore, the Lynchburg Registrar and Electoral Board, handpicked by the local party establishment, refused to keep them separate from other ballots.

Mixing these ballots all together is not unlike mixing sand in a bottle — it is impossible to undo.

We’re aware that members of the Electoral Board and election officers have been big financial supporters and advisors to my opponent. Now, we’re fighting to stop them and fix this disastrous situation.

On election day, we fought the party establishment and won. This is just another battle against them. This is just another battle we are going to win.

We are committed to ensuring that every vote is counted fairly, and no undue influence or party establishment impacts the integrity of this election and your votes. I remain confident in a fair outcome on election day and trust that the integrity of our election process will be upheld.

A special thank you to Team McGuire for alerting us to these ‘miracle ballots’ and standing strong for free and fair elections.
Thank you for your continued support.

Chris

P.S. Your contributions are greatly appreciated. Our campaign has utilized funds transparently and ethically, and we now need your assistance to ensure the integrity of this election.

Now, there is a video of Lynchburg election officials admitting they left the ballot drop box out for days after the election and accepted mail-in ballots days after Election Day.

Official admitting that there’s no security camera installed.

This is a shocking video.

Once again, it shows how broken policies and unserious officials are ruining the trust Americans have in our elections.

Merchan’s Sham Verdict Violated The Constitution In Spades – Unpacking Some Of The Most Grievous Abuses

We are now a little over two weeks away from President Trump’s sentencing, scheduled for July 11th at 10:30 AM Eastern Time in New York City. By this point, millions of Americans are keenly aware of the legal onslaught initiated by Biden and the Democratic Party against Donald Trump, which has deeply impacted the integrity of our judicial system.

No longer can a criminal defendant, especially one with dissenting or pro-Trump views, be confident that his constitutional rights will be upheld in every court across the nation.

This stark reality, which runs counter to longstanding American principles, underscores the critical stakes of this year’s election cycle. Essentially, what’s at stake is not just democracy, but the very integrity of our justice system.

While Donald Trump and Joe Biden’s names will appear on the ballot this fall, voters will effectively choose between two fundamentally divergent – and incompatible – forms of governance: one rooted in constitutional principles that uphold the rule of law, due process, and myriad cherished guarantees.

The other, a despotic system that displaces those liberties with brute force.  This system is one in which the supposedly democratically elected “leader” gets reduced to a mere figurehead, clearly lacking his mental marbles, who is in turn absorbed into a centralized bureaucratic apparatus managed by shadowy overseers working to subvert the will of the American people from behind the scenes with their own, self-interested goals.

The guilty verdict in President Trump’s case marked a significant turning point, a proverbial Rubicon moment, in American judicial history. Convicting a past and future president, who remains one of the most popular and respected figures in American politics, is unprecedented in our nation’s history. Such a brazen assault on the Constitution would have been inconceivable to the Founding Fathers.

Judge Merchan’s disregard for constitutional norms and established legal precedents, including recent Supreme Court decisions requiring unanimous jury verdicts, highlights his departure from the judicial oath to uphold the Constitution’s core principles.

His actions, such as imposing a gag order on President Trump with shameless abandon, that inhibited his ability to address conflicts of interest involving the judge, not only violated the First Amendment – and otherwise established judicially disqualifiable financial ties between he judge and case – but also ignored well-established legal standards.

This includes recent Supreme Court precedent that, for example, imposes a constitutional obligation of unanimous jury verdicts, which traces its roots all the way back to English common law, arising in the fourteenth century.

Of course, being an avowed enemy of Anglo-American jurisprudence, Merchan saw fit to abandon that venerable tradition, and instead adopt a legal predisposition readily found in communist and socialist societies like Cuba, Venezuela, or the former Soviet Union, where the prosecution of political enemies is commonplace.

In doing so, Merchan has sided decisively with the enemies of the American system, who, rather than heeding Lincoln’s eternal proverb, that right makes might, has instead acted with a Machiavellian vengeance that punishes its enemies without recourse to due process or the presumption of innocence.

If Merchan – and by extension, Alvin Bragg and Joe Biden – have their way, our civilization is at risk of plunging into a dark age of barbarism and tribalistic bloodlust, which will mark the end of America.

Here are just a few examples of constitutional provisions that Judge Merchan flouted by convicting President Trump, grounds for which his verdict is demonstrably unconstitutional and illegitimate:

First Amendment: As Harvard Law Professor Emeritus, Alan Dershowitz, spelled out in a Wall Street Journal column this weekend (and as I have written at great length previously), Judge Merchan’s gag order is a flagrant breach of the First Amendment.

In his article, Professor Dershowitz explained the issues surrounding the gag order, which rests on highly tenuous authority.  The first, being the scope of the order – which is unprecedented both in breadth and content.  First, rarely ever has a gag order been so egregiously misapplied – and lasted so long, all the way through the verdict and still ongoing!

The fact that there were two iterations of this gag order, both of which were designed to quash President Trump’s political speech is bad enough.  The defendant has every right under the sun to critique the judge and jury of perceived bias – especially here, with a judge that, on numerous fronts, should have recused himself for contributing directly to the Biden-Harris campaign; for having a wife who was once employed by Letitia James, Bragg’s Attorney General; and for having a daughter who is president of a consulting firm that has made millions from representing political clients, including the Biden-Harris campaign, creating a direct pecuniary stake in the outcome of this case.

It is not hard to see how an immediate family member of Judge Merchan – namely, his daughter – might receive a financial windfall from a guilty verdict.

Beyond that, Merchan’s use of the gag order as a sword against the defendant, rather than as a shield to protect the defendant from outside threats, which is the ordinary use of such orders, is equally without precedent and violative of well-established law.  As I have previously written:

Only in the rarest of cases has the Supreme Court upheld prior restraints on speech.  In the few cases where the Court has upheld gag orders, a form of prior restraint, the order was necessary to achieve a compelling state interest.  In other words, the Supreme Court has only permitted gag orders that satisfied the extremely high burden of strict scrutiny analysis.  Where gag orders are at issue, strict scrutiny compels courts to limit the scope of the order to an articulable set of facts – the facts encompassing the order must be extremely particularized and limited in scope, and only considered as a final option if and when all other alternatives to help ensure a fair trial have been totally exhausted.

Thus, gag orders are only ever to be used as a last resort option, and only in the most exceptional cases when the right to a fair trial would otherwise be severely jeopardized without it.  In the rare cases where a gag order would be appropriate, again the court must take great pains to ensure that it is structured in such a way as to be particularized to a highly limited set of facts that have a direct bearing on the integrity of the proceeding – and go no further.  The gag order should always be temporary, with a definitive start time and expiration date, terminating whenever the danger that resulted in its issuance in the first place subsides, or immediately once alternative, less constraining methods that would ensure a fair proceeding become available, whichever comes first.

This past weekend Professor Dershowitz corroborated in his own piece what I had written months ago:

It is important to remember that a gag order is a prior restraint on speech. The First Amendment prohibits prior restraints except in the most extraordinary circumstances, in which important countervailing interests are at stake. In New York Times Co. v. U.S. (1971), the Pentagon Papers case, the Supreme Court rejected such claims by the government and allowed the media to publish sensitive classified information. Prior restraints may also be permissible to protect the integrity of continuing jury trials, though the constraints must be narrowly tailored to actual dangers to fair-trial rights. Here any such dangers, if they ever existed, ended when the trial concluded. The judge has almost certainly already decided on the sentence he would impose, and even if he hasn’t, allowing the public (and him) to hear what Mr. Trump has to say wouldn’t endanger the sentencing process.

In sum, President Trump has every right, as a criminal defendant, to criticize the proceedings.  That is routine.  Even if the trial were done properly and in accordance with law – which, of course, it emphatically was not – the defendant still would retain that fundamental right.

One does not simply lose one’s all-important right to speak, particularly on matters essential to the defendant’s liberty interests – such as the prejudiced composition of the jury, or political biases of the venue or judge – when the stakes are highest; indeed, to the contrary, that is when the need to preserve the right to speak freely is greatest.

Nor does the judge get to rewrite centuries of well-settled case law because he has a personal gripe against the defendant.  Nor when he has a financial or professional stake in the defendant’s guilty verdict, and/or a vendetta with Anglo-American jurisprudence overall, which, having absorbed the tenets of critical race theory, he likely considers an oppressive creation of evil white men.

Just one of these are more than enough grounds for a recusal (and at least one is grounds for Judge Merchan’s disbarment).  Never mind the fact that the defendant was and will be again the President of the United States, whose rights deserve extra care – and any deprivation thereof, extra scrutiny – given the monumental political stakes that are implicated by the trial and judgment, whose shockwaves are bound to reverberate across American society.

Fifth and Sixth Amendments:  Arguably even more pernicious than Judge Merchan’s trampling over the First Amendment is his running roughshod over fundamental rights guaranteed in the Fifth and Sixth Amendment – namely, the requirement that due process be upheld, for one; and that every count be proven on their elements beyond a reasonable doubt, for two.

The latter bespeaks the constitutional requirement of unanimity, a requirement perpetuated over centuries of practice, and reaffirmed in two very recent Supreme Court decisions: Ramos v. Louisiana (2020) and again, just last week, in Erlinger v. United States (2024).

The unanimity requirement is most directly affirmed in Ramos, where the High Court stipulated in an 8-1 ruling the Sixth Amendment’s requirement that “the government must prove to a jury every one of its charges beyond a reasonable doubt.”

Perhaps anticipating a direct appeal to the Supreme Court from President Trump’s lawyers based on the Ramos precedent, the Court also elaborated the principle of unanimity in Erlinger.  There, the Court said that “‘any fact’ that ‘increase[s] the prescribed range of penalties to which a criminal defendant is exposed’ must be resolved by a unanimous jury beyond a reasonable doubt.”

Reading these two decisions together, the Court first reaffirmed the condition that felonious guilty verdicts be unanimous.  Through the Fourteenth Amendment, that constitutional right applies equally in content to criminal verdicts in state court as much as it does to federal courts.

Moreover, in Erlinger, the Supreme Court described that one of the components of unanimity is that the government must prove every element of every crime alleged beyond a reasonable doubt.  In other words, the now infamous 4-4-4, mix-and-match jury verdict that Judge Merchan allowed in his instructions is a flagrant violation of both Erlinger and Ramos.

This is because the government must show, in a case alleging multiple crimes, that the defendant is guilty of either all crimes, or, at the bare minimum, of one of the three alleged crimes.  That crime must have each of its elements spelled out, at which point the government has the burden of showing that each element met the burden of proof.

Here, that did not occur.  Nobody other than the jury knows which of the three crimes the President was indicted on.  That is plainly improper and blatantly unconstitutional.

For all we know, four of the jurors may have found President Trump guilty on crime A, but not crimes B and C, while another four might have found the President guilty of crime B, and not A and C, and so on.

This is why the guilty verdict has been colloquially dubbed a “mix-and-match” or “smorgasbord” – the judge violated the obligation of unanimity by allowing jurors to pick any charge they individually felt met the burden of proof, without having to be in consensus over which one.

Those instructions clearly infringe the holdings from Erlinger and Ramos.  In turn, they deny President Trump of due process and other fundamental rights.  This is because the requirement for unanimity is contained in the Sixth Amendment, which has been incorporated to the states via the Due Process Clause of the Fourteenth Amendment.

In other ways, President Trump’s right to due process has been abridged – he was unfairly prejudiced all throughout the trial through the salacious and defamatory testimony of Stormy Daniels and Michael Cohen, as just one instance.  But the most direct violation might be the Judge’s disregard for unanimity, a requirement older than the Constitution itself.

This egregious violation raises other doubts about whether the burden of proof was met at all for any charge alleged (jury deliberations were notably kept under lock and key) – in turn, raising other, maybe even stronger, grounds for due process challenges.

Other Constitutional Violations: In addition to blatant and unprecedented violations of the First, Fifth, and Sixth Amendments, Merchan violated a litany of other constitutional provisions and rules of evidence and professional conduct.  He flouted rules governing venue and jurisdiction.

For starters, it is extremely dubious that an alleged federal election law violation, which was asserted in the judge’s instructions, could be brought in state court.  In particular, the purported crime in question – a FECA violation, is governed exclusively by the Federal Election Commission.

The FEC is a civil agency of the federal government that already cleared the federal election law violations asserted by Bragg and Merchan.  Under normal circumstances, this charge should have been preempted by the FEC.  At the bare minimum, as a civil agency, the FEC lacks prosecutorial authority, and cannot prosecute criminal matters without bringing in the Department of Justice.

So, the basis upon which a state court can “prosecute” a federal election law violation that is routinely treated as a civil, and not criminal, matter is beyond anyone’s comprehension – an important nuance in the law that clearly eluded both judge and jury here.  Again, the fact that this alleged violation previously received an FEC clearance raises very strong grounds upon which to believe the underlying matter was not criminal at all, and certainly not felonious.

There are of course more violations, too numerous to count.  The Rules of Evidence, particularly governing inadmissible hearsay and the prohibition of prior bad acts that have no bearing whatsoever on the case at hand, were ignored with shameless abandon.

The Judge acted inappropriately by excluding certain expert witnesses, such as the FEC Commissioner that was supposed to flesh out the legal analysis I briefly articulated above.

Merchan also admonished the one defense witness, Robert Costello, with a generally favorable view to President Trump and his case.  Merchan acted so plainly outside the bounds of proper judicial conduct, even for an acting state court judge, which is what he is, that he should have been dismissed from the case – and indeed disbarred.

As a judge, it is wholly improper to have a financial interest in the outcome of any decision, let alone continue presiding over it.  This not only denies the defendant his fundamental right to a fair trial, but maybe even more devastatingly, it has lasting detrimental effects on the trust and integrity of the criminal justice system overall.

Now, tens of millions of Americans have a jaded view of the prospect of free and impartial justice in this country.  The damage done to the integrity of the rule of law may be irreparable; it could well take generations to rehabilitate some semblance of the esteem American lawcourts once universally enjoyed in the eyes of the public – the real tragedy is the likelier prospect that it may never happen.

Over two hundred years of Anglo-American law, customs, and norms have been sabotaged in Judge Merchan’s courtroom.  Even if President Trump is exonerated, what has been allowed to take place already is, without exaggeration, the greatest miscarriage of justice ever committed in American history.

The Left prides itself all the time for preserving democratic institutions; but the damage that Merchan, Bragg, and ultimately Joe Biden have wrought to our democratic institutions is unforgivable – because, unlike past injustices, this one may be permanent.

If America dies, these diabolical men will have delivered the fatal blow.  Hundreds of years of our inheritance has been squandered in a matter of weeks by vengeful evildoers who are operating to destroy our system, root and branch.

This cannot be tolerated; this will not be tolerated.  Americans have every right in the world to be outraged by what is occurring.  Should he be reelected, President Trump will have a mighty task on his hands to restore integrity and order in our judiciary, which is of paramount importance if we are going to persist in the years to come as a free nation.

Wisconsin Elections Commission Accused of Being in Contempt of Court for Disregarding Temporary Restraining Order

The Wisconsin Elections Commission (WEC) is facing criticism for violating a temporary restraining order that’s in place concerning absentee ballot envelopes. The news comes on the heels of the partisan August 13 primary, just as clerks are preparing to mail out ballots.

On Monday, June 24, lawyers representing a Wisconsin voter named Thomas Oldenburg filed a motion accusing WEC of being in contempt of court.

For context, a Marinette County judge granted a temporary restraining order last month against WEC, saying that the state election commission must not require clerks to use newly-designed absentee ballot envelopes until the judge makes a final ruling. According to state law, these ballot envelopes were designed in a manner that violates existing Wisconsin election laws.

According to Wisconsin law, an absentee voter requesting a ballot via email must submit a signed ballot application inside of his or her ballot envelope in order for it to be counted. However, WEC attempted to roll out a new ballot envelope that requires voters to certify the envelopes themselves are the applications, which lawyers argue violates existing state election laws since an envelope can’t replace a legally-required application form.

Despite the judge’s order, WEC held a public meeting on June 10, 2024 where the commission openly discussed plans to disregard the TRO. The meeting can be viewed here via WisconsinEye.

“I think as an agency we should be proud of this envelope and encourage all of our clerks to please continue to use it because it’s really a terrific envelope,” said Commissioner Ann Jacobs.

WEC counsel Jim Witecha also said, “The form is not required for mandatory use and kind of recommend they proceed as they see fit. We do not believe that at this time it should impact the voters or the clerks if they continue to use it.”

Witecha also implied that the ruling only applies to Marinette County, even though the TRO applies statewide and impacts clerks in all Wisconsin counties. Now, clerks are currently under “tremendous pressure” to utilize the EL-122 due to WEC’s actions.

The Commission then voted 6-0 that, “This temporary injunction does nothing more than make the use of Form EL-122 voluntary rather than mandatory. Accordingly. clerks and voters can still use Form EL-122 without violating the temporary injunction.”

Wisconsin-based attorneys Daniel Eastman and Kevin Scott represent Mr. Oldenburg. According to Monday’s court filing, WEC has directly violated the Order by asking Clerks to utilize the EL-122.

The commission said it sees no issue publicly violating this TRO because of a presumed lack of legal consequences.

“It is unlikely that using the Form EL-122 before a final decision in Oldenberg would subject a clerk or voter to criminal liability for using a document that has served as a certificate and application for many years,” the commission said.

Although it is noted that the offending language was only adopted by WEC in fall of last year.

“WEC had ample time to address its impact and assist the clerks of this state—essentially WEC’s wards—to pursue an alternative plan in compliance with the Order and Wisconsin law,” Eastman and Scott wrote in the contempt of court filing on Monday. “Instead, WEC chose to double down and try to run out the clock in violation of multiple state laws and defiance of this Court.”

A scheduling hearing is scheduled for Friday, July 26.
