A federal judge on Tuesday revised the restrictions on access to the Treasury’s payment system.

As previously reported, corrupt Obama Judge Paul Englemayer on Saturday issued an ex parte Temporary Restraining Order (TRO) forbidding all of Trump appointees, including Treasury Secretary Scott Bessent, from accessing Department of Treasury data in response to a lawsuit filed by 19 Democrat state attorneys general.

The case was ultimately assigned to a Biden judge for a decision.

US District Judge Jeannette Vargas, a Biden appointee, responded to the Trump Admin’s emergency motion to dissolve, clarify or modify Englemayer’s ex parte TRO.

The Trump Admin argued in their motion papers that “the TRO contravenes Article II of the Constitution to the extent it applies to political appointees, in particular the Secretary of Treasury and other senior Treasury leadership.”

Judge Vargas kept most of the restrictions in place, but she allowed Secretary Bessent and other in Treasury leadership to access the payment system.

As if a judge is allowed to restrict the Treasury Secretary from accessing treasury data.

“There is nothing in the record to indicate that, prior to January 20, 2025, any statute, regulation, or agency policy prohibited the Secretary of Treasury or any other Senate-confirmed officer within the Treasury Department’s senior leadership from accessing any Treasury Department payment record, payment systems, or any other data systems maintained by the Treasury Department containing personally identifiable information and/or confidential financial information of payees,” Judge Vargas wrote in an 8-page order reviewed by The Gateway Pundit.

Judge Vargas however, kept intact the ban on DOGE workers from accessing the Treasury Department’s payment system and data.

“However, to the extent that Defendants seek to eliminate the TRO’s restriction on access by “political appointees” more broadly, Defs. Mem. at 5-6, the Court denies the motion,” Judge Vargas wrote.

The White House announced Tuesday that it had secured the release of Marc Fogel, an American international school teacher imprisoned in Russia for the possession of marijuana since 2021. Fogel’s release was negotiated by Steve Witkoff, President Donald Trump’s special envoy to the Middle East.

Mike Walz, Trump’s national security advisor, said that the negotiation “serves as a show of good faith from the Russians and a sign we are moving in the right direction to end the brutal and terrible war in Ukraine.” Trump promised during the 2024 presidential campaign to bring the Russo–Ukrainian War to a quick end.

Fogel’s family also released a statement, saying that they were “beyond grateful, relieved, and overwhelmed that after more than three years of detention, our father, husband, and son, Marc Fogel, is finally coming home.”

House Speaker Mike Johnson (R-LA) didn’t hold back during a fiery press conference with GOP leadership on Tuesday morning, delivering a blistering critique of the Democrat Party’s newfound love with the “rule of law” after four years of excusing and enabling Joe Biden’s lawless agenda.

Johnson sarcastically “welcomed” the Democrats to the concept of legal governance, highlighting their blatant hypocrisy in suddenly invoking the rule of law now that President Trump is taking decisive action to clean up Washington.

Johnson: “As I said last week, the Democratic Party is in a completely different place right now. There’s no identified leader of the party. They don’t have a clear vision. They seem rudderless.

In hopes of finding themselves, they’ve latched onto this new shiny object called the rule of law. Well, we’d like to welcome them to the concept.

It would be admirable if they hadn’t spent the last four years with their heads buried in the sand while Biden literally trampled over the rule of law with no objection.”

Johnson went on to list the many ways in which the Biden administration willfully violated the Constitution with the full backing of Congressional Democrats.

Johnson: “In fact, many Democrats cheered that lawlessness, like when the Biden administration unconstitutionally forced the middle class to pay the student loans of doctors and lawyers, when they illegally mandated that private companies implement vaccine requirements, when they radically rewrote Title IX to undermine women’s rights.

Those things were actually illegal, and the Democratic Party cheered it. They didn’t oppose it at all.

He then contrasted Biden’s reckless overreach with President Trump’s lawful use of executive authority.

Johnson: “President Trump, by contrast, is taking legitimate executive action to root out waste, fraud, and abuse in all these federal programs.

That’s what the American people demand and deserve. That’s what they voted for. They voted for real analysis and transformational change in the way the federal government works.

The only people who take issue with it are these same Congressional Democrats who never before had any issue with unelected staff or even bureaucrats running the White House for the last four years. That’s not what’s happening here.

The President has empowered his new cabinet secretaries and the DOGE effort, and all of these divisions in the executive branch of government to go and find where the abuses have taken place.

Every time something new is unearthed and uncovered, and we share it with the people, they applaud that this has been discovered, and they want us to keep going. That’s what’s going to happen.”

Johnson also defended Trump’s administration from the activist judges attempting to interfere with the executive branch’s lawful authority, echoing sentiments from Vice President J.D. Vance.

“When Congress appropriates dollars for the executive branch to use, we build in not only in the spirit of the law, but in the letter of law, a broad amount of discretion for how that is used.”

“There is a presupposition in America that the commander in chief is going to be a good steward of taxpayer dollars, that the commander in chief, the President of the United States, is going to command those within his branch of government to do the right thing by the people, to be accountable, to not fund drag shows…”

Concerned Veterans for America (CVA) is calling for a foreign policy of restraint and a halt to runaway federal spending in its newly released 2025 policy priorities, warning that unchecked security commitments and deficit spending pose long-term risks to the United States.

The advocacy group, which was previously headed by Secretary of Defense Pete Hegseth, emphasizes that a prudent and restrained foreign policy accompanied by a budget that prevents additional growth of the national debt is the best policy for both veterans and their families and for Americans in general. These priorities align it with a growing conservative push for foreign policy realism in the new Trump administration.

“We’re focused on providing for a strong national defense as the center of our foreign policy, and we believe that that means having a clear view of American vital interests,” Tyler Koteskey, the policy director at CVA, told The American Conservative. CVA’s plan highlights that the U.S. military is tasked with defending 1.4 billion people worldwide despite limited resources. As a result, “we need to reassess how we engage with different parts of the world, like the Middle East,” continued Koteskey. 

As part of this recalibration, the group calls for implementing NATO burden-shifting by reducing U.S. troop deployments to NATO countries, encouraging greater leadership in the alliance from European NATO allies, and transitioning the American role in the alliance to one of logistical support rather than frontline defense. This will allow the U.S. to concentrate its resources on emerging threats in Asia.

Additionally, the policy statement suggests that the U.S. should reject taking on any further security commitments. These include potential additions to NATO such as Georgia and Ukraine, as well as any concessions to Saudi Arabia as part of an agreement to normalize relations with Israel. “America should cultivate alliances when they directly advance U.S. security,” the agenda reads. “It should not pursue them merely out of an abstract commitment to partnership.”

CVA’s statement comes at a critical time for American foreign policy as the new Trump administration is weighing how to pursue its goals abroad during the president’s second term and Republicans are debating the proper stance on American involvement abroad. CVA’s call for reduced NATO commitments aligns with Trump’s past criticisms of the alliance. However, its opposition to further security commitments in Ukraine and Saudi Arabia could complicate U.S. efforts to broker an end to the war in Ukraine or expand the Abraham Accords—both of which are stated priorities for Trump in his second term.

Another major goal of CVA’ 2025 policy platform is achieving a sound fiscal foundation for the American economy and government. “We agree with former CJCS Chairman Admiral Mike Mullin that the national debt is America’s ‘greatest security threat’ over the long term,” Koteskey said. Getting “the United States on a sustainable fiscal path is vital to our ability to sustain the forces that are necessary to protect our interests around the world.” To curb federal spending and promote a strong American economy, CVA proposes automatic budget measures to prevent shutdowns, a requirement for Congress to pass a single, comprehensive budget each year, and limits on government expenditures tied to economic growth. 

“When we are $36 trillion in debt and experiencing a debt-to-GDP ratio [we] haven’t had since World War II, we [must change] the course of our fiscal policy to be more sustainable,” said Koteskey.

As the second Trump administration takes shape, CVA’s policy priorities align it with a growing faction of conservatives advocating for foreign policy restraint and fiscal discipline. Whether these proposals succeed will depend on how the U.S. navigates competing pressures over NATO, Ukraine, and defense spending in the years ahead.

A federal judge on Tuesday ordered the Trump Administration to restore the gender ideology webpages it deleted.

US District Judge John Bates of the United States District Court for the District of Columbia, a George W. Bush appointee, ordered Trump to restore the pages by midnight tonight.

Last month, President Trump scrubbed public health websites of all things related to “gender ideology.”

A group dubbed Doctors For America sued the Office of Personal Management and numerous government agencies, claiming the removal could prevent doctors from helping patients.

Judge Bates agreed with Doctors for America and ordered the extremist ideology to be restored.

“Defendants shall, in consultation with Plaintiff, identify any other resources that DFA members rely on to provide medical care and that defendants removed or substantially modified on or after January 29, 2025, without adequate notice or reasoned explanation; and defendants shall, by February 14, 2025, restore those resources to their versions as of January 30, 2025,” Judge John Bates wrote in an order reviewed by The Gateway Pundit.

A federal judge ordered federal health agencies Tuesday to restore pages they removed from their websites last month to comply with President Donald Trump’s executive order on “gender ideology and extremism,” saying the decision to pull them down could be detrimental to public health.

The decision by U.S. District Judge John Bates, a George W. Bush appointee, came after a testy Monday afternoon hearing in which he sharply questioned the administration about doctors’ claims that the removal of the pages damaged their ability to care for patients.

Bates said Tuesday that the pages’ removal appeared to harm some doctors’ ability to treat patients and was done without any public rationale, recourse or ability to challenge the decisions, despite laws and regulations that typically require them.

Will alien technology be a manufacturing differential in the near future? Should you be investing in it?

While many people are skeptical about the very existence of alien life – let alone the viability of utilizing alien tech – the folks at Tuttle Capital are making a big bet on it being a game-changer in the economy and in the markets.

Tuttle has filed with the SEC to invest in ‘reverse-engineered alien technology’ with the ‘Tuttle Capital UFO Disclosure AI Powered exchange traded fund’, which is one of eight new products the manager has registered, regulatory filings show.

Financial Times reported:

“With the ticker UFOD, the actively managed UFO Disclosure AI Powered ETF will invest at least 80 per cent of its net assets in a basket of companies that Tuttle Capital ‘believes have potential exposure to advanced or ’reverse-engineered’ alien technology, spurred by disclosures about UFOs and alleged advanced technologies’, the registration statement reads.

Those companies will include aerospace groups and defense contractors that may have research and development programs ‘rumored to work with classified technology, potentially leading to groundbreaking advancements’, the filing says.”

Alien tech a differential?

CEO of the company, Matthew Tuttle, has had an interest in UFOs for years.

He believes investing in UFO tech may be the smart move.

“’I’m a trader. I look at [UFOs] and I say that they’re using a power source that is light years beyond anything that we have.  If our government has this technology and it’s released, that will be a game-changer’, he said.”

The ETFs will be traded on the Cboe BZX Exchange, but they do not yet have set launch dates.

“The ETF will short companies that are threatened or could be made obsolete because of any ‘alien-level’ technology that is discovered, its registration states.”

But Tuttle alerts that if information from government disclosures on UFOs are not forthcoming, the product might not go to market.

“’Government confirmation or denial of advanced alien tech is uncertain, and rumored breakthroughs might never materialize. This entire theme is highly speculative and subject to rumor cycles’, reads a paragraph in the registration statement on the speculative nature of the proposed ETF.”

On August 1, 2023, Jack Smith announced four charges against former President Donald Trump as part of his investigation into the 2020 election.

Last month President Trump’s DOJ asked the 11th Circuit Court of Appeals to drop Jack Smith’s classified documents case.

On Tuesday, after a two-week delay, the 11th Circuit Court of Appeals dismissed Jack Smith’s classified documents case against President Trump and co-defendants Walt Nauta and Carlos De Oliveira.

Judge Aileen Cannon over the summer dismissed Jack Smith’s classified documents case based on unlawful appointment and funding of the special counsel.

Jack Smith indicted Trump on 37 federal counts in Miami in June 2023 for lawfully storing presidential records at his Mar-a-Lago estate which was protected by Secret Service agents.

Trump was charged with 31 counts under the Espionage Act of willful retention of national defense information and 6 other process crimes stemming from his conversations with his lawyer.

FBI agents spread docuements from Mar-a-Lago on the floor during their raid on President Trump’s home.

Walt Nauta, a former White House employee and Navy veteran who worked valet for Trump and served as a personal staffer at Mar-a-Lago was indicted along with Trump in 2023.

According to the federal indictment reviewed by The Gateway Pundit, Nauta was charged along with Trump in counts 32, 33, 43, 35, and 36.

The charges include conspiracy, withholding a document or record, corruptly concealing a document or record, concealing a document in a federal investigation and scheme to conceal.

Walt Nauta was also charged alone in count 38: False statements and misrepresentations.

Jack Smith also charged Carlos De Oliveira, a maintenance worker who helped Trump aide Walt Nauta move boxes of documents around at Mar-a-Lago.

Carlos De Oliveira, 56, was added to the obstruction conspiracy charges in a superseding indictment in 2023.

Cannon dismissed Jack Smith’s case based on both unconstitutional elements: The appointment by US Attorney Merrick Garland and the unlimited funding given to Jack Smith – both without the approval of Congress.

Trump’s Justice Department went scorched earth last month and fired more than a dozen officials who worked on former Special Counsel Jack Smith’s team.

Topline: Alexander Eastman, the U.S. Customs and Border Protection acting chief medical officer, is accused of drinking while carrying a firearm and rewriting government purchasing rules to buy fentanyl lollipops. He is the highest-paid employee in the history of the Department of Homeland Security, according to payroll records obtained by OpenTheBooks.com.

Key facts: Eastman was hired in 2017 with a salary of $133,443. By 2020, he was earning $301,146, making him the first and only Homeland Security employee with a salary above $300,000.

He has been the highest-paid employee in the department every year since, with a salary of $323,933 in 2024.

Eastman worked at the University of Texas Southwestern Medical Center as an assistant professor of surgery from 2009 to 2018, earning at least $300,000 in taxpayer-funded salary nearly every year.

His university salary topped out at $363,320 in 2017 — the same year he was hired by Homeland Security, meaning he collected salary from both the federal government and the State of Texas. Eastman also earned concurrent salaries in 2018.

In total, Eastman earned $4.7 million from taxpayers from 2009 to 2023. The figure includes $1.7 million from the federal government and $2.9 million from Texas.

Eastman’s LinkedIn page indicates he was also employed by the Dallas Police Department from 2004 to 2016, but he is not listed in OpenTheBooks’ Dallas payroll records.

Background: Eastman was the Acting Chief Medical Officer for U.S. Customs and Border Protection while on assignment from Homeland Security, beginning in 2023.

In February 2024, whistleblowers working with the Government Accountability Project sent a letter to Congress with allegations against Eastman.

Eastman allegedly tried to order fentanyl lollipops for a helicopter trip to the United Nations in New York City in September 2023, spending “copious hours of staff time” with several employees on the “urgent” request.

Eastman allegedly said the lollipops were needed for “pain management” in case an employee was injured during the trip, or they encountered a “patient in need.”

When told the lollipops would violate department procurement rules, Eastman allegedly wrote a new set of rules and signed it himself. In the end, employees could not find a lollipop seller in time for the trip.

The same letter claimed that Eastman “has frequently spoken lewdly about women … creating a hostile environment for employees.” Employees also said Eastman “frequently” travels between Washington D.C. and his home in Texas, a “gross waste of taxpayer dollars” to “accommodate his remote work.”

Another letter in May accused Eastman of drinking alcohol while wearing a pistol around his waist “on multiple occasions,” which would violate employee conduct rules.

In December, Eastman was reassigned back to Homeland Security headquarters.

Summary: Eastman is innocent until proven guilty, but if any of the allegations are true, that’s no way for a Chief Medical to behave, especially not while being paid  $323,933.

With Donald J. Trump back in charge of America and the U.S. economy, I hear everyone talking about tax cuts. Tax cuts for corporations. Tax cuts for individuals. Tax cuts for the middle class. Tax cuts for everyone and everything- except small business.

And all of that is great. I’ve been fighting for lower taxes my whole adult life. Like my heroes Ronald Reagan and NFL quarterback-turned-New York Congressman Jack Kemp, I’ve never met a tax cut I didn’t like! Tax cuts are good for business. And like the old saying goes…

“The business of America is business.”

I was the original creator and cheerleader for “No Tax on Social Security Benefits” and “No Tax on OT.” I’m thrilled and honored that President Trump adopted both ideas after I sent him my columns in early 2024 (and then lobbied hard for him to adopt them as his campaign themes).

And President Trump has kept his campaign promises- he is pushing for the GOP House and Senate to pass both tax cuts. That’s what makes Trump so special.

These two ideas will serve double duty. They will bring tax relief to “the little guy and gal.” Which will put more money in the pockets of middle-class Americans. And what will they do with this money? They will spend it- a powerful boost to the economy.

That’s always what tax cuts do. People take the money and spend it. That creates more income for businesses, who create new jobs, and hire new employees. That creates higher revenue and therefore higher income taxes, higher payroll taxes, and higher sales taxes. Everyone wins.

But why is no one talking about tax cuts specifically for small business owners?

Small business is “the economic engine of America.” Small independent businesses create most of the private sector jobs and taxes in America. And they are the greatest form of opportunity for middle class Americans.

Starting a small business is the best way to move up in life and live the American Dream. I’m a witness.

I am a S.O.B. (son of a butcher). My grandfather owned the butcher store that my father worked at. That little butcher store turned my grandfather from a penniless immigrant into a self-made upper middle-class businessman, and respected leader of the community. It created jobs. It created income taxes, payroll taxes and sales taxes.

That little butcher store paid for a nice home, nice middle-class lifestyle, and paid for myself and my sister to attend Ivy League Columbia University.

That’s the American Dream.

And my grandfather took his profits from that little butcher store and plowed them right back into America. He bought stocks and held them until the day he died. Those small investments into American companies like IBM, Coca Cola and Exxon helped grow those companies and added millions of jobs to the US economy.

My grandfather and his small business were good for America.

Today we need to create and motivate millions of new small business owners. We need to make starting a small business so attractive that everyone wants to do it. Because if we double the number of small businesses, we will create the greatest economy in history! We will turn millions of Americans from poor to middle class, and from middle class to rich, and leaders in their community. Just like my grandfather.

So, let’s start talking about how to make that happen.

Let’s start thinking about ways to cut taxes specifically for small business owners and small business startups, instead of only talking about corporate tax cuts.

Let me get the party started. Off the top of my head, I can think of three ways to do this.

1. A specific small business startup tax credit. Anyone who starts a new business should get an instant $25,000 tax credit off this year’s taxes. This will encourage millions of Americans to invest in a startup.

2. A specific tax cut just for small business owners. Why not make the first $100,000 of income of any small business tax free? That is a fitting reward for the cost of undertaking the hardest job in the world- starting and running a small business. First, you have to be willing to give up your safe salary and benefits at a corporate job. Then you have to invest your life savings. And you have to be willing to work 24/7.

I’m 63 years old and I’m still a one-man army. I work and think about business 24/7. Ask my wife about that. Owning a small business is the hardest job in the world. It becomes your life 24/7 to take care of your restaurant, dry cleaner, gas station, real estate office, butcher store (or in my case, media business).

Why not give everyone who does this a tax break? The first $100,000 is yours, not governments. That’s a strong incentive for everyone in America to start thinking about starting a small business.

3. Finally, since the income of 90% of small business owners is “passed through” to them personally, let’s lower individual income tax rates dramatically- just like my hero Reagan did. If a 15% corporate tax rate is good enough for big companies, why not individuals? Why is a company more important than any individual American?

Let’s get individual tax rates down to Reagan-era numbers. Under Reagan there were only two simple flat tax rates- 15% and 28%. Not today’s ridiculous, socialist-like 39%.

If President Trump can turn these three goals into reality, he will go down in history as the not only the greatest economic president ever, who created the greatest economy in history, but the greatest president ever for small business and “the little guy and gal.”

That will be the most lasting and positive legacy of President Donald J. Trump.
