The Justice Department on Friday told a federal judge that it is seeking a grand jury indictment against James Comey.
Former FBI Director James Comey is facing indictment again — this time for disclosing classified information.
Comey was hit with two charges on October 5 in the District Court for the District of Columbia. The charging document was made public on Monday.
This is the third criminal case that the Trump DOJ has brought against Comey.
The new criminal charges are related to Comey’s illegal disclosure of classified information to the New York Times.
Comey’s lawyers filed a motion to dismiss, arguing that the new charges are invalid because Comey has not been indicted by a grand jury.
The former FBI Director’s attorneys also argued that the case should be thrown out because the charges are past the statute of limitations.
Judge McFadden scheduled a hearing on Comey’s motion to dismiss.
During Friday’s hearing, the DOJ told McFadden that they are seeking to indict Comey based on new evidence.
“We are still going to the grand jury very diligently,” Special Assistant US Attorney Dustin Farahnak said in a hearing in DC before Judge Trevor McFadden, a Trump appointee.
Infamous Deep State DC lawyer Michael Dreeben is representing James Comey in the Justice Department’s latest criminal case against the former FBI Director.
Michael Dreeben worked as a prosecutor in two separate witch hunts against President Trump. Special Counsels Robert Mueller and Jack Smith both added Michael Dreeben to their teams.
