Weaponized Lawfare: An Army Colonel’s Defamation Suit Raises Questions on Patriotism, Free Speech, and Freedom of the Press

Legal retaliation over comments is raising critical questions about the intersection of patriotism, free expression, and legal accountability.

According to a report by the Washington Examiner, on October 10, the Oversight Project successfully transferred a defamation lawsuit filed by Army Colonel Junel Jeffrey against retired Army Major Dr. Charles “Chase” Spears from the D.C. Superior Court to the United States District Court for the District of Columbia.

This move changes the presiding judges to Article III federal judges, allowing Spears a more accessible route to the U.S. Supreme Court if necessary.

The lawsuit arises from public comments made by retired U.S. Army public affairs officer Dr. Spears in September 2025, concerning a social media post attributed to Col. Jeffrey, a senior U.S. Army public affairs officer stationed at the Pentagon.

Following the assassination of conservative commentator Charlie Kirk, Col. Jeffrey posted remarks on social media that included a reaction to Kirk’s murder, which Spears highlighted as a troubling instance of ideological extremism within the Armed Forces.

“Sometimes we reap what we sow,” read the post from a social media account featuring Jeffrey’s name and image.

Spears not only claimed that Col. Jeffrey was “the only one brazen enough” to publicly celebrate Kirk’s assassination, noting that she represents a significant segment of her colleagues, but he also penned an opinion article for RedState to express his concern.

“We failed to defeat Al Qaeda over the course of two decades,” he wrote. “Worse still, we allowed the American left wing to import that foreign terrorist association’s agenda, tactics, and desired end state: violent destruction of those marked as ‘infidels.’ Then we gave these neo-Qaeda agents safe harbor in the ranks of our military.”

The Oversight Project is now representing Spears in this case against him for these comments and more, marking a significant expansion of its legal efforts to defend individuals perceived as patriotic allies facing lawfare. The organization aims to combat the weaponization of legal systems against conservatives exercising their constitutional rights.

In a recent press release, President Mike Howell expressed outrage over the celebrations surrounding Charlie Kirk’s assassination, stating, “It speaks to a deep sickness our country needs to get a handle on. The act of noticing this evil is not defamation. The Oversight Project isn’t going to sit back and watch patriotic Americans be targets of lawfare any longer.”

Jeff Clark, the group’s vice president for litigation, also condemned Col. Jeffrey’s actions, describing them as “appalling” and “deeply disturbing.” He asserted that Col. Jeffrey’s defamation lawsuit against Spears in the amount of tens of millions of dollars exemplifies “weaponized lawfare.”

The Oversight Project’s legal battle on behalf of Spears is emblematic of a larger fight against the misuse of the judicial system to silence and intimidate those who speak out against extremist views. As the case progresses in the federal court, it not only seeks justice for Spears but also serves as a rallying point for others who face similar challenges.

JUST IN: FBI Agents Fired Over Their Roles For Targeting Trump in Classified Documents Case Sue to Get Their Jobs Back

The nine former FBI agents fired for their roles in Jack Smith’s classified documents case are suing the FBI and Director Kash Patel for their jobs back.

The disgruntled agents said they were fired without cause.

FBI Director Kash Patel fired the agents in February 2026.

The former agents argued that they never volunteered to work on the “Plasmic Echo” case, but rather were assigned to it because of their roles in counterintelligence.

NBC News reported:

Nine former FBI employees involved in the classified documents case against President Donald Trump filed suit Thursday against FBI Director Kash Patel and Attorney General Todd Blanche, alleging their firings were “unlawful.”

The group’s suit says they were fired without cause for their work on the case involving Trump, and that the firings appeared to be politically motivated. It noted they were booted while FBI Patel was being criticized by the administration for partying with the U.S. Olympic hockey team.

FBI Special Agent Miles Starr, who was working in a unit called the “Director’s Advisory Team” that was apparently formed to look into Trump’s perceived political enemies, had demanded urgent access to the “Plasmic Echo” case file — the code name for the investigation into the classified documents case — on Feb. 23, the lawsuit says.

That was after video of Patel chugging a beer and “flinging alcohol around the U.S. men’s hockey team’s locker room at the Winter Olympics in Milan, Italy, began circulating widely on social media and news sites,” the suit says.

The file had the names of the agents who’d worked on the investigation, and they were summarily fired over the next few days without any of the required due process, the suit says.

“Each Plaintiff was provided with a termination letter signed by Director Patel” that falsely claimed that they had exercised “poor judgment and a lack of impartiality in carrying out their duties, leading to the political weaponization of the government,” the suit says.

(VIDEO) Election Denier Kamala Harris in South Korea Says Democrats Are Going to Win Despite Republicans’ “Overt Cheating”

Kamala Harris speaks at an Asan Institute for Policy Studies lecture in Seoul, South Korea

Kamala Harris was in South Korea this week talking about the upcoming US election, which she accused Republicans of cheating in, but said Democrats are going to win.

Harris appeared at an Asan Institute for Policy Studies lecture in Seoul, South Korea, fueling speculation about her plans for 2024.

Per the Washington Times:

Ms. Harris, the 2024 Democratic presidential nominee, was in South Korea at the invitation of the Asan Institute, a prominent Seoul think tank, to deliver its annual memorial lecture.

The lecture cut a broad swath, linking geopolitics and U.S. alliances to the race for primacy in global tech and the import of secure supply chains.

Given the timing — less than three weeks ahead of the midterms — and the support Ms. Harris has for another presidential bid, Asan got a hot speaker.

She currently leads a crowded field of potential candidates for her party’s 2028 nomination. An Oct. 11 Focaldata/Financial Times survey found 30% of Democrats back her — double the numbers of runner-up Gavin Newsom, governor of California, with 15%.

Notably, she used the appearance to push what Democrats have long considered a conspiracy theory: cheating in elections. Harris has adopted the narrative that Republicans are rigging the elections with attempts to pass voter ID measures, removing inactive and illegal voters, or “purging” the voter rolls, and redistricting in red states.

She has even started using Trump’s signature catchphrase, “Too big to rig.”

“There have been overt attempts to deny fair and free elections, as we all know,” she said during her Wednesday appearance at the panel in Seoul. She ironically went on to deny the fairness of the upcoming election.

“In the United States, there’s been overt cheating happening around the elections process, whether it be the purging of the voter rolls or Redrawing districts outside of the season when that would happen.”

“So I say all that to say that we are facing a lot of obstacles, but the Democrats are going to win,” she continued.

WATCH:

Meanwhile, the left-wing media is trying to corner Trump and get him to say he’ll accept the election results.

As The Gateway Pundit reported, Trump was asked last week by a reporter if he’ll accept the results “no matter what party wins,” and he responded, “What do you think? Of course I will, but we don’t want cheating. We don’t want cheating in the midterms.”

“We don’t want cheating. Do you understand me?” he added.

WATCH: Trump Suggests “Full Blast” War on Cartels in Mexico is “Starting”

President Trump delivers remarks in the White House Rose Garden – October 15, 2026

President Trump on Thursday said targeting of the Mexican drug cartels on land has been ongoing for months and that a “full blast” attack on the drug traffickers is now underway.

Trump delivered the remarks at a Rose Garden lunch with first responders this afternoon.

A White House official said the following organizations were in attendance: International Association of Fire Fighters, National Volunteer Fire Council, the National Sheriffs Association, the National Association of Police Organizations, National Volunteer Fire Council, International Association of Chiefs of Police, National Fraternal Order of Police, National Sheriffs’ Association, the Federal Law Enforcement Officers Association, National Border Patrol Council, and International Association of Chiefs of Police.

The comments about an escalation with the cartels on land come amid escalating hostilities between the cartels and US law enforcement. Earlier this month, US Coast Guard personnel reportedly exchanged gunfire with individuals across the border in Starr County, Texas. Also this month, a Mexican cartel threatened to kidnap federal agents at the Texas-Mexico border.

Hundreds of additional US troops have recently been deployed to Texas’ Rio Grande Valley.

“I will tell you the drugs coming in by sea, by ocean, by sea are down 97 percent, and we don’t understand why it’s not 100 percent,” Trump said on Thursday, highlighting the US military and Coast Guard’s war on drug trafficking vessels in the Eastern Pacific and the Caribbean Sea.

He then said that a “full blast” targeting of the cartels on land is “starting.”

“We haven’t even started — we haven’t done the land full blast yet, but it’s starting. We have to work,” Trump said. “We’re working with Mexico, but unfortunately the cartels run Mexico.”

“I tell that to the president of Mexico. She’s not happy. She’s a great woman, wonderful woman, but the cartels run Mexico, but we’ve hit them hard, and it’s very, very — we wanted to do the sea and the water first because the water that’s harder to do, and people didn’t realize that a big percentage of the drugs come in by the sea, by the water,” Trump continued.

WATCH:

Trump later said, “The land is really just starting. It started a few months ago. We’re hitting them very hard.”

“We know all the paths, we know where all the bad guys are, the cartels, we know where they live, and we’re hitting them hard, but it’s going to be harder as we go along. They know they have a certain period of time to essentially give up.”

“Mexico should be doing it, but honestly, they’re not capable of doing it,” he continued.

Woke Democrat Kansas Senate Candidate Calls for “Repentance Over White Privilege” in Resurfaced Video

Adam Hamilton/Image: Video screenshot via YouTube

Woke Democrat pastor Adam Hamilton is hoping to defeat incumbent Republican Senator Roger Marshall (R-KS) in Kansas.

A resurfaced video, however, may not help his efforts in the deep-red state,

In the summer of 2020, during the height of the violent and destructive George Floyd riots, Hamilton suggested members of his congregation at the Church of the Resurrection recognize their “White privilege” and “repent.”

Hamilton said in the video, “Like part of what I know is that, is that I grew up in a way that I’m blind to certain things in our society.”

“I just am. And I have certain benefits by virtue of being educated, White, and male, right?”

“And we don’t like to hear that, especially White folks don’t like to hear that. But there are benefits that come along with that.”

He continued, “There are benefits and privileges to my place in life. I have to recognize that. To see that. And then I have to listen. I have to listen and understand, and finally be able to see the brokenness in myself, and my indifference.”

“Before I can do anything to help anyone else, I have to have a conversion. I have to repent.”

Watch (begins at 19:14):

According to The New York Post, Hamilton has also been accused by Marshall of failing to report a pedophile, who once worked at Hamilton’s church, to law enforcement.

“Hamilton, who has served as lead pastor at Church of the Resurrection in Leawood for more than three decades, caught flak from a Democratic primary opponent for allowing the employment of Scott Moore, a church volunteer accused of molesting teenage boys at two retreats in 2005 and 2006.”

Marshall released an ad highlighting the accusation.

“What did Hamilton do when victims reported him to church leaders? Parents were ignored, and Hamilton never called the police,” the narrator says.

The ad continues, “The next fall, Hamilton welcomed him back. Free to lurk for new victims — later convicted of more child sex crimes.”

“Adam Hamilton protected a pedophile. He should never be our senator.”

A postal worker depositing letters into a blue USPS mailbox outside a government building with an American flag in the background.

Suspicious letters containing white powdery substance sent to election offices ahead of the midterms.

The letters were sent to Secretary of State’s offices in Louisiana, Ohio, and Oklahoma.

NBC News reported:

Secretaries of state’s offices in Ohio, Louisiana and Oklahoma were sent packages this week with mysterious powders, just weeks before the offices are set to oversee the midterm elections.

Oklahoma and Louisiana reported receiving the envelopes, while Ohio said U.S. Postal Service investigators intercepted a package destined for it.

The national groups representing secretaries of state and state election directors expressed concern about the suspicious letters in a letter Wednesday.

“As we have each stated in the past, threats against election officials and workers have no place in our democracy. Those who administer our elections should never fear for their safety while carrying out their essential duties,” the National Association of Secretaries of State and the National Association of State Election Directors said in a joint statement.

“The FBI and U.S. Postal Inspection Service are investigating a series of suspicious mailings sent to various addresses nationwide, including Secretary of State offices and their related election offices. Some of the letters contained an unknown substance and we are working closely with our law enforcement partners to respond to each incident. We are also working with our partners to identify the individual or individuals responsible for the letters. This FBI will continue to safeguard the public and secure elections for American citizens.”

“Election officials take these matters seriously and work closely with law enforcement and security partners to protect their personnel and facilities,” the statement added.

Ohio Secretary of State Frank LaRose said these kinds of “cowardly threats will not deter us” from delivering secure and accessible elections.

James Talarico Tries To Play Moderate at CNN Town Hall, Gets Owned on Abortion by Catholic Voter

Texas Democratic Senate candidate James Talarico made an appearance at a town hall hosted by CNN in collaboration with Jubilee on Wednesday evening.

The format CNN used was reminiscent of Jubilee’s “Surrounded” series, where one individual must face a barrage from naysayers who disagree with their views.

For Talarico, opposition came from a Roman Catholic woman who made it known she was a single-issue voter, with everything coming down to abortion.

After expressing her hesitance to vote Democrat because of the party’s poor track record on the issue, Talarico tried to respond as a moderate, attempting to find common ground with someone he considered a fellow Christian.

“Some of my spiritual heroes like Pope Francis and Pope Leo are pro-life, and they are consistently pro-life,” he told her. “I can respect anyone like you who is consistently pro-life,” Talarico said, hoping to find “common ground.”

The Senate hopeful then tried claiming “the Bible is silent on the issue of abortion.”

He tried desperately to distance himself from the line from the Democrats’ long-held stance on murdering children, telling the woman, “You and I actually have the same goal. We may have different moral conclusions when it comes to this particular ethical question, but we actually have the same public policy goal.”

Although he kept rambling, this voter would not let his comment on Scripture go unaddressed.

“I just want to add that the Bible is not silent on abortion. There is the 10 Commandments: thou shalt not kill.”

Talarico simply told her, “It’s okay that you and I come to different conclusions about that.”

No, it definitely is not okay.

How can voters who oppose the slaughter and dismemberment of children find any common ground with Talarico or his party?

For all of the mental gymnastics he tries here, the issue is black and white.

Either you support the murder of children in the womb, or you do not.

Talarico’s understanding of Scripture is strange, but more accurately abhorrent. That tracks well with leadership at his church claiming Jesus did not die for our sins and that we cannot know if He even existed.

The town hall gave audiences more moments like this as he tried to inch away from the radicalism Democrats have spent years endorsing.

Deviating from the “Abolish ICE” narrative the left uses with Immigration and Customs Enforcement, Talarico said, “We need Immigration and Customs Enforcement in this country, but that’s not what we’re seeing,” commenting, “What we’ve seen over the last year is a secret police force, and that’s what we don’t want in this country.”

Sure, calling ICE the “secret police” is not moderate, but it’s a step back from the lunacy of the left by at least understanding the agency is needed.

Talarico maintains a slim lead over his Republican opponent, Texas Attorney General Ken Paxton, as the New York Post, citing RealClearPolling, puts him ahead by 2.6 percentage points.

He’s trying to tread lightly until November, but abortion is not a middle ground issue with room for nuance. We are talking about the murder of innocent children.

Oscar-Nominated Director Declares ‘Hollywood Is Over’ Amid Industry Shifts

On Monday, accomplished filmmaker Ava DuVernay stood before the BFI London Film Festival audience and declared, “Hollywood is over.”

According to The Hollywood Reporter, the Oscar-nominated documentarian shared that the era of institutional control was coming to an end.

“It’s done. They’re buying each other, they’re collapsing. It’s all changed,” DuVernay said. “They’re selling studio lots. The idea of going to Sundance and getting a three-picture deal from Harvey Weinstein? He’s in prison.”

Instead of being financed by the major media companies, DuVernay suggested crowdfunding through different “kinds of apps and sites” as an alternative.

“Everything has changed,” said DuVernay.

The question she attempted to answer was, “What can we build now that’s new, that serves more kinds of people and kinds of stories?”

These comments come amid commercial success for low-budget independent releases in 2026.

Curry Barker’s $522 million hit “Obsession” and Kane Parker’s $400 million psychological horror “Backrooms” were two of 2026’s most successful films.

But these films were not products of established film companies. They were from small indie creators.

Shooting on relatively small budgets, selling directly to audiences, and sidestepping the usual Hollywood studios allowed them to produce very successful cinema.

They are not the only ones stepping away from traditional media.

Reporting from Politico in August 2026 revealed a large physical exodus from the 30 Mile Zone around Los Angeles’ studios. Film companies are moving operations to Illinois, Georgia, and New York.

Financial incentives to leave California have driven many successful filmmakers away from the Golden State.

A June investigation by The Hollywood Reporter found that many of these film locations have been taken over by small content creators or influencers.

DuVernay confirmed the decentralization of the industry.

According to The Hollywood Reporter, she shared that “more and more, it will be about artists and audiences connecting directly without a middle man or company that brings them together.”

DuVernay’s documentary “14th” has a limited theatrical release on Nov. 27, 2026, followed by its global streaming premiere on Netflix on Dec. 4, 2026.

The movie examines the 14th Amendment, the context behind its ratification, and the battles surrounding it today.

Fort Hood Shooter’s Execution Won’t Be Live-Streamed, Trump Says

The execution of Nidal Hasan, the former U.S. Army major who carried out the mass shooting at Fort Hood in 2009, will not be live-streamed, President Donald Trump announced Thursday.

“He will die, as scheduled, by firing squad, but this event will not be streamed,” Trump wrote on Truth Social. “That said, the execution may be viewed in person by the immediate families of the victims, if they so choose.”

Secretary of Defense Pete Hegseth had said last Thursday that the execution would be conducted by firing squad and that it would be “public,” and the Pentagon said it would be live-streamed.

Americans overwhelmingly oppose live-streaming the execution—80 to 18 percent—according to new polling by the Washington Post and ABC News.

After the Pentagon’s announcement, the Trump administration debated calling off the livestream, CNN reported Tuesday. During those conversations, the president learned Hasan is paralyzed from the waist down and uses a wheelchair, raising concerns for Trump about the event’s imagery.

DOJ Gives California 48 Hours to Check Noncitizen Names on Voter Rolls or Face Emergency Action Before Midterms

The Justice Department has given California 48 hours to review a federal list of people it believes are noncitizens who were mailed ballots for the November 3 midterms, or face emergency legal action.

Acting Deputy Attorney General R. Trent McCotter sent letters Tuesday to Secretary of State Shirley Weber and Los Angeles County Registrar-Recorder Dean Logan.

The department handed over a password-protected thumb drive listing individuals federal officials “believe are likely noncitizens” who received vote-by-mail ballots.

California began mailing ballots to more than 20 million registered voters on October 5.

The letters demand that officials review the list within 48 hours.

For anyone whose citizenship cannot be independently confirmed, the DOJ wants the state and county to segregate returned ballots, not cancel them, and refrain from verifying signatures or tabulating them until citizenship is determined.

Officials are told to withhold ballots for anyone on the list who has not yet been sent one.

“If you cannot implement this process by then, given the ongoing federal election, the United States will have no choice but to seek emergency relief,” the letter states.

McCotter wrote that “Allowing noncitizens to vote cancels citizen votes.”

Weber pushed back in her response.

“In July of this year, President Trump and DHS Secretary Markwayne Mullin made (still) unsubstantiated claims that California had 190,000 noncitizens on its voter rolls. Given the many high-profile examples of states purging U.S. citizens from their voter rolls based on DHS/SAVE data, SOS immediately requested written information about their methodology and data sources to back up their claims. They refused and provided California with nothing,” Weber said in a statement, according to a report from Fox News.

“Now the USDOJ, under threat of ‘emergency’ litigation, demands that California blindly trust this administration without any evidence or legal authority to justify its request,” she said.

Weber continued, “The USDOJ’s relentless efforts to unlawfully gain access to states’ protected voter data and purge voter rolls serve only to cause chaos and fuel public distrust in our elections. California has robust state law requirements that only U.S. citizens can register to vote and that any non-eligible registrants are removed from the State’s voter rolls. My office and California election officials remain committed — as always — to ensuring a fair and smooth 2026 General Election.”

Logan’s office has not opened the drive, citing security concerns.

“The letter included a USB drive purportedly containing the referenced records, along with a handwritten note providing a password. We have not accessed the drive because doing so would conflict with established data privacy and information security protocols. We do not consider the device a secure medium. Additionally, the letter does not specify the number of individuals involved or describe the information contained in the records,” Logan said in a statement.

Late last month, the Supreme Court allowed states to use the Department of Homeland Security’s Systematic Alien Verification for Entitlements (SAVE) system to check voter eligibility for now, after a lower court blocked the expanded version.

Trump signed an executive order directing the creation of a federal voter-registration list and new restrictions on mail voting.

A DOJ spokesperson said the request “should not be controversial” because “only American citizens may vote in federal elections” and “it is a federal crime for noncitizens to vote.”
